Terms of Use

These Terms govern your access to and use of the ThoughtReps websites, app, ThoughtReels, media-processing tools, downloads, sharing features, and related services.

Effective: September 27, 2026

1. Agreement to these Terms

ThoughtReps is currently operated by Paul Tongyoo. In these Terms, “ThoughtReps,” “we,” “us,” and “our” refer to Paul Tongyoo operating the ThoughtReps service. By accessing or using ThoughtReps, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

If you use ThoughtReps on behalf of an organization, team, school, business, or another person, you represent that you have authority to bind that organization or person to these Terms.

2. Eligibility and minors

You must be at least 13 years old to create an account or use ThoughtReps as an account holder. If you are under the age of legal majority where you live, you may use ThoughtReps only with the permission and appropriate involvement of a parent or legal guardian.

Parents and guardians are responsible for supervising a minor’s use of ThoughtReps and for deciding whether the service and any uploaded or shared media are appropriate for that minor.

ThoughtReps may let you optionally choose an Age Group for a ThoughtReel (General, 13–15, 16–17, or 18+). We use that setting to adapt ThoughtRep wording so it is easier to understand at different ages. The setting is not age verification, does not require a birth date, and does not change these eligibility or parent/guardian requirements.

3. What ThoughtReps is—and is not

ThoughtReps is a tool for practicing mental-performance routines and organizing personal performance media. It may include self-talk prompts, Focus cards and attention exercises (such as breathing or ball-tracking drills), personal videos, photos, text Moments, media editing, sharing, exporting, and related features.

ThoughtReps is not medical care, mental-health treatment, psychotherapy, diagnosis, counseling, or a substitute for a qualified healthcare professional. It is also not a substitute for professional athletic coaching, safety instruction, legal advice, or other professional services.

Do not use ThoughtReps as an emergency or crisis service. If you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis resource.

4. Your account

You are responsible for providing accurate account information, keeping your login credentials secure, and all activity performed through your account. Do not share passwords or authentication links. Notify us promptly if you believe your account has been accessed without authorization.

5. Your content and media

You retain ownership of the videos, photos, text Moments, custom ThoughtReps, and other content you submit to ThoughtReps (“User Content”). You grant ThoughtReps a non-exclusive, worldwide, royalty-free license to host, store, copy, transcode, crop, resize, render, display, transmit, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the service and to carry out actions you request, such as playing, sharing, or exporting a ThoughtReel.

You represent and warrant that you have all rights, permissions, consents, and legal authority needed to upload and use your User Content through ThoughtReps. This includes any rights needed for people depicted or heard in the media, including minors, teammates, students, spectators, family members, performers, or other third parties.

If you upload team, school, league, workplace, performance, or event footage, you are responsible for complying with applicable rules, policies, privacy expectations, recording laws, intellectual-property rights, and publicity rights. Do not upload footage taken in places where recording would be unlawful or reasonably expected to be private.

Custom ThoughtReps and other editable text fields are intended for constructive personal development, preparation, encouragement, reflection, and mental-performance practice. Your responsibility for User Content applies whether you keep it private, include it in a shared ThoughtReel, or include it in an exported video.

6. Sharing, links, and downloads

ThoughtReps may let you share a ThoughtReel through a temporary link, download/export a video, or use Add to a device to authorize ongoing view-only access on a specific phone or tablet. You control whether you initiate those actions. A paired device does not receive the owner’s edit, share, download, account, or settings privileges, and the owner may revoke that device’s access. If you separately share content or exported files, recipients may still be able to view, copy, save, record, forward, or re-share what you make available, and ThoughtReps cannot control copies made outside the service.

Before sharing content involving another person—especially a minor—consider whether you have the appropriate permission and whether the sharing is appropriate for the audience.

Because custom ThoughtReps and other user-entered text may be included in shared ThoughtReels or exported videos, you are responsible for making sure the text you create is appropriate for its intended audience and does not expose recipients to prohibited, abusive, threatening, or otherwise harmful material.

7. Appropriate use

You may use ThoughtReps only for lawful purposes and in a way that respects the safety, privacy, and rights of others. You may not:

These rules apply to all User Content, including private content, custom ThoughtReps, shared ThoughtReels, and exported videos. ThoughtReps is designed to support constructive self-improvement, but constructive content can still acknowledge difficult emotions, mistakes, fear, frustration, or other real experiences.

8. Sports, physical activity, and assumption of risk

ThoughtReps does not supervise, organize, or control your participation in sports, exercise, performances, travel, or other physical activities. Those activities can involve risk of injury, property damage, emotional stress, or other harm. You are responsible for deciding whether and how to participate, following appropriate rules and safety instructions, using suitable equipment, and consulting qualified professionals when needed.

To the fullest extent permitted by law, you voluntarily assume the risks associated with activities you choose to participate in and with decisions you make based on your use of ThoughtReps. To that same extent, you release and discharge ThoughtReps and Paul Tongyoo from claims arising from the inherent risks of sports or other activities you voluntarily undertake, from the acts or omissions of third parties outside ThoughtReps’ control, and from your own decisions about how to use ThoughtReps content or features. Nothing in these Terms releases, excludes, or limits liability that cannot lawfully be released, excluded, or limited.

9. Mental-performance content and results

ThoughtReps does not promise that a ThoughtRep, Focus exercise, ThoughtReel, Moment, or other feature will improve performance, confidence, mental health, relationships, outcomes, or results. People may respond differently to the same exercise or content. You are responsible for deciding what content is appropriate for you or a minor you supervise.

If using ThoughtReps causes distress or seems unhelpful, stop using that exercise or the service and consider speaking with an appropriate qualified professional.

10. Automated and AI-assisted features

ThoughtReps may offer automated or AI-assisted features, such as processing media or identifying moments in longer footage. Automated outputs can be incomplete, inaccurate, inappropriate, or unexpected. You are responsible for reviewing generated text, selected clips, edits, and other outputs before relying on, saving, sharing, or publishing them.

Do not treat automated output as professional medical, mental-health, legal, safety, or other expert advice.

11. Content moderation and enforcement

We may investigate suspected violations of these Terms and may remove or restrict User Content, including custom ThoughtReps, disable sharing, limit features, suspend accounts, or terminate access when we reasonably believe it is necessary to protect users, third parties, ThoughtReps, or the service. We are not obligated to monitor all User Content and do not endorse User Content merely because it is available through the service.

12. ThoughtReps intellectual property

Except for User Content, ThoughtReps and its software, designs, branding, logos, product names, curated content, interfaces, and other materials are owned by ThoughtReps or its licensors and are protected by intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service as provided. They do not transfer ownership of ThoughtReps intellectual property to you.

13. Feedback

If you voluntarily give us ideas, suggestions, bug reports, or other feedback about ThoughtReps, you grant us permission to use that feedback without restriction or compensation, provided that this does not give us ownership of your User Content.

14. Third-party services

ThoughtReps depends on third-party infrastructure and services, including hosting, authentication, cloud storage, analytics, email delivery, and processing providers. Your use of third-party websites or services may also be subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control.

15. Beta features, changes, and availability

ThoughtReps is an evolving product. Features may be experimental, incomplete, renamed, changed, limited, or discontinued. We may modify usage limits, storage limits, media-processing behavior, sharing behavior, pricing, or availability. We do not guarantee uninterrupted access, permanent storage, or that any feature will remain available.

Marketing pages may describe planned Game Film, AI-assisted, or other features before they are generally available. Joining a notification list does not purchase a service and does not guarantee that a feature will launch at a particular price or time.

16. Paid services

ThoughtReps may offer paid subscription plans, including ThoughtReps Plus. The price, billing period, renewal terms, cancellation terms, and any additional purchase terms are shown before you are charged. Subscription payments are processed by our payment provider. Unless a checkout flow expressly states otherwise, product-interest or “Notify me” actions for unavailable features do not collect payment.

17. Termination

You may stop using ThoughtReps at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, misuse the service, or if we discontinue the service. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, indemnity, and dispute terms—will survive.

18. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THOUGHTREPS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, OR THAT THE SERVICE WILL BE ERROR-FREE OR SECURE.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THOUGHTREPS AND PAUL TONGYOO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, LOSS OF GOODWILL, OR PERSONAL OR BUSINESS LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THOUGHTREPS AND PAUL TONGYOO FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THOUGHTREPS FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot legally be limited.

20. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless ThoughtReps and Paul Tongyoo from claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising out of or relating to your User Content, your violation of these Terms, your violation of another person’s rights, or your unlawful or unauthorized use of the service.

21. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a formal claim, you and ThoughtReps agree to make a good-faith effort to resolve the dispute informally by written notice describing the issue and requested resolution.

Unless applicable law requires otherwise, any dispute that is not resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction and venue of those courts.

22. General terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, acquisition, sale, or transfer of the service. These Terms and the Privacy Policy are the entire agreement between you and ThoughtReps regarding the service unless additional terms are presented for a specific feature.

23. Changes to these Terms

We may update these Terms as ThoughtReps evolves. We will post the revised version and update the effective date. If a change is material, we may provide additional notice when appropriate. Your continued use of the service after revised Terms take effect means you accept the revised Terms to the extent permitted by law.
